Terms & Conditions, Assumption of Risk, Release of Liability & Media Release

Effective: September 2026

By booking, registering for, attending, or participating in any lesson, class, course, camp, clinic, club activity, event, or other archery program offered by On Point Adventures LLC d/b/a Archery by Eleanor (“Archery by Eleanor”), the participant, or the participant's parent or legal guardian if the participant is a minor, acknowledges and agrees to the following:

1. Assumption of Risk

I understand that archery is a physical sporting activity involving bows, arrows, targets, equipment, other participants, and indoor or outdoor environments.

I understand that participation involves inherent and other reasonably foreseeable risks, including but not limited to injuries caused by arrows, bows or other equipment; equipment malfunction or failure; improper use of equipment; other participants; slips, trips, falls, uneven terrain, physical exertion, strains, collisions, heat, sun exposure, dehydration, wind, rain, storms, insects, wildlife, and other range or environmental conditions.

I understand that these risks may result in property damage, minor or serious bodily injury, permanent disability, or death.

I knowingly and voluntarily choose to participate and assume the inherent and reasonably foreseeable risks associated with participation in archery and related activities.

2. Release and Waiver of Liability

To the fullest extent permitted by Arizona law, I release, waive, discharge, and agree not to sue On Point Adventures LLC d/b/a Archery by Eleanor, Eleanor Rodriguez, and their respective employees, instructors, coaches, assistant coaches, contractors, volunteers, representatives, and agents (collectively, the “Released Parties”) for claims arising out of or relating to my participation in an Archery by Eleanor activity.

This release expressly includes, to the fullest extent permitted by law, claims arising from the ordinary negligence of a Released Party, including ordinary negligence relating to instruction, coaching, supervision, equipment selection, equipment setup, range procedures, or other acts or omissions.

This Agreement does not release any person or entity from liability that cannot lawfully be waived or released under Arizona law.

3. Safety Rules and Participant Conduct

I agree to follow all instructions provided by coaches and range personnel; all applicable range, facility, club, and USA Archery safety rules; and all shooting-line, whistle, timing, and cease-fire commands.

I agree to handle and use bows, arrows, and other equipment only as instructed, never intentionally use archery equipment in an unsafe manner, and never retrieve arrows or cross the shooting line until instructed that it is safe to do so.

I will immediately report damaged equipment or unsafe conditions to an instructor.

Archery by Eleanor may refuse, suspend, or immediately terminate participation when an individual behaves unsafely, disregards instructions or range rules, intentionally misuses equipment, interferes with the safety of others, or appears impaired by alcohol, drugs, or another substance.

Removal for unsafe or inappropriate behavior is non-refundable.

4. Health and Ability to Participate

I am responsible for determining whether I am physically capable of safely participating.

I agree to inform my instructor before participating of any injury, physical limitation, disability, or other circumstance for which I am requesting an accommodation or modification to instruction.

Participants should stop participating and inform an instructor if they experience pain, dizziness, illness, or another condition that makes continued participation unsafe.

Archery by Eleanor does not provide medical advice or medical treatment.

5. Equipment

Archery by Eleanor may provide bows, arrows, protective equipment, and other archery equipment for participant use. I agree to use all provided equipment only for its intended purpose and as instructed.

Archery by Eleanor reserves the right to prohibit the use of personal equipment that an instructor reasonably determines is damaged, unsafe, improperly configured, inappropriate for the participant, or unsuitable for the activity.

Participants may be responsible for damage to equipment resulting from intentional misuse, reckless conduct, or deliberate failure to follow instructions.

6. Outdoor Activities, Heat, and Weather

Many Archery by Eleanor activities take place outdoors in Arizona.

I understand that outdoor participation may involve heat, direct sunlight, wind, rain, storms, uneven ground, insects, wildlife, and rapidly changing weather conditions.

Participants are responsible for arriving appropriately prepared, including bringing sufficient water and appropriate clothing, footwear, and sun protection.

Archery by Eleanor may delay, modify, reschedule, relocate, or cancel an activity when weather, range conditions, facility conditions, or another circumstance makes participation unsafe or impractical.

7. Cancellations, No-Shows, and Refunds

Cancellations must be made at least 24 hours before the scheduled lesson, class, or activity to be eligible for a refund.

Cancellations made within 24 hours of the scheduled start time and no-shows are non-refundable.

If Archery by Eleanor cancels an activity because of unsafe weather, range closure, instructor availability, or another circumstance preventing the activity from taking place, participants will be offered an appropriate rescheduling or refund option.

8. Minors

A participant under 18 must have these Terms accepted by their parent or legal guardian.

By accepting these Terms for a minor, the parent or legal guardian represents that they have legal authority to consent to the minor's participation, acknowledges the risks associated with archery, and consents to the minor's participation.

The parent or guardian accepts these Terms on their own behalf and, to the fullest extent permitted by Arizona law, on behalf of the minor.

9. Paseo Vista Archery Club, JOAD, and USA Archery Activities

Archery by Eleanor works in conjunction with Paseo Vista Archery Club/JOAD, and certain beginner classes or other programs may be planned and hosted as club activities for the purpose of introducing participants to archery and direct club membership recruitment.

When an activity qualifies as a USA Archery member-club activity, participants are also subject to applicable USA Archery and club requirements, policies, safety rules, membership requirements, and required releases.

Participation in an Archery by Eleanor activity does not by itself make a participant a member of Paseo Vista Archery Club, JOAD, or USA Archery.

Where required, participants must complete any additional USA Archery or club release, membership, or registration documentation.

Archery by Eleanor's Terms & Conditions do not replace any separate release or documentation required by USA Archery, Paseo Vista Archery Club/JOAD, a range, facility, event organizer, or other applicable organization.

10. Third-Party Facilities and Organizations

Activities may take place at public ranges or facilities owned, operated, or controlled by third parties.

Participants agree to comply with applicable rules and requirements imposed by the facility, range, club, governing body, or event organizer.

Unless expressly stated otherwise, nothing in these Terms represents that every Archery by Eleanor activity is operated, sponsored, sanctioned, endorsed, or insured by USA Archery, Paseo Vista Archery Club/JOAD, the City of Chandler, or any other third party.

11. Emergency Medical Assistance

If an injury or medical emergency occurs, I authorize Archery by Eleanor personnel to contact emergency medical services and provide reasonable assistance while awaiting professional responders.

I understand that Archery by Eleanor cannot guarantee the availability or outcome of emergency medical treatment.

I am responsible for medical, ambulance, transportation, or other expenses incurred on my behalf or on behalf of a minor for whom I am responsible.

12. Personal Property

Participants are responsible for their own bows, equipment, phones, vehicles, valuables, and other personal belongings.

To the fullest extent permitted by law, the Released Parties are not responsible for personal property that is lost, stolen, misplaced, or damaged during an activity.

13. Photography, Video & Media Release

By participating in an Archery by Eleanor activity, I understand that photographs, video, or other recordings may be taken during lessons, classes, programs, events, or club activities.

I grant On Point Adventures LLC d/b/a Archery by Eleanor permission to photograph, film, or otherwise record me and to use my image, likeness, and voice for legitimate business and promotional purposes, including Archery by Eleanor's website, social media, advertisements, educational materials, and other digital or printed marketing.

I understand that these materials may be published publicly and that I will not receive compensation for their use. I waive any right to inspect or approve the finished materials.

For a participant under 18, the parent or legal guardian accepting these Terms grants this permission on behalf of the minor.

Participants who do not wish to be photographed or recorded must notify Archery by Eleanor in writing before the activity begins. Archery by Eleanor will make reasonable efforts to honor the request.

14. Governing Law, Venue, and Severability

These Terms are governed by the laws of the State of Arizona.

To the extent permitted by applicable law, any legal proceeding arising out of or relating to participation in an Archery by Eleanor activity shall be brought in a court of competent jurisdiction in Maricopa County, Arizona.

If any provision of these Terms is determined to be invalid or unenforceable, that provision shall be enforced to the maximum extent permitted by law, and the remaining provisions shall remain in effect.

15. Electronic Acceptance

I understand that my electronic acceptance of these Terms is intended to constitute my agreement to them.

Electronic acceptance, including checking the required agreement box during registration or booking, is intended to have the same effect as my written acceptance to the extent permitted by applicable law.

16. Acknowledgment

I acknowledge that I have had the opportunity to read these Terms before participating.

I understand the nature of the activities and the risks associated with archery.

I understand that these Terms contain an Assumption of Risk and Release and Waiver of Liability, including a release of certain claims arising from ordinary negligence.

I also understand and agree to the Photography, Video & Media Release contained in these Terms.

I understand that by accepting these Terms I am giving up certain legal rights.

I voluntarily agree to these Terms as a condition of participating in activities offered by On Point Adventures LLC d/b/a Archery by Eleanor.
